Data Protection Acknowledgment & Consent

I hereby acknowledge that I have read and understood the Sacco’s Data Privacy Notice and General Terms and Conditions, as well as the applicable Data Protection laws and regulations of Kenya.

I understand how my personal data will be collected, processed, stored, and used by the Sacco and its authorized entities. By signing this acknowledgment, I consent to the lawful processing of my data by the Sacco and recognize my rights regarding:

  • Access to my personal information
  • Correction of any inaccuracies in my data
  • Deletion of my personal information when necessary
  • Transfer of my data in accordance with regulatory provisions

Additionally, I acknowledge that the Sacco has implemented appropriate measures to ensure the security and confidentiality of my data.


General Membership Terms

Admission to Membership

An applicant shall be admitted to membership but will not qualify for the rights and privileges of membership until they have fulfilled the following financial requirements:

  • Paid an entrance fee of KShs. 1,000
  • Maintained a minimum share capital of KShs. 40,000
  • Made a minimum monthly contribution of KShs. 3,000, as determined by the General Meeting

Additionally:

  • Society shares are non-refundable.
  • Refusal of admission: The Board may refuse admission to a person, citing reasons for their decision. The affected individual may appeal at the next Annual General Meeting through a registered member, as provided in the Act.
  • Disputes at the time of a member’s death: If a dispute arises regarding membership upon a member’s death, the proceeds will be paid to the Public Trustees.

A person of either gender is eligible for membership if they meet the following qualifications:

  • At least 18 years old
  • No convictions for criminal offenses involving fraud or dishonesty
  • Within the approved field of membership, as outlined in the member policy

Upon registration, all members will automatically receive a FOSA account, with a minimum balance requirement of KShs. 500.

Cessation of Membership

Membership in the society shall cease under the following circumstances:

  • Death
  • Voluntary withdrawal
  • Expulsion from the society
  • Certified insanity
  • Transfer of shares
  • Declaration of bankruptcy by a court of law
  • Failure to meet membership qualifications, as stated in the by-laws

Withdrawal from the Society

A member may withdraw from the society by submitting a written notice of sixty (60) days. If they wish to reapply for membership in the future, they must:

  • Pay a registration fee of KShs. 1,000
  • Ensure all loan balances are fully cleared before withdrawal

Expulsion from Membership

A member may be expelled or suspended by the General Meeting under the following grounds, as outlined in the Act:

  • Engaging in activities detrimental to the society’s interests, such as making deliberately false statements to the Board, the Supervisory Committee, the Ad Hoc Committee, or the Annual General Meeting.
  • Failure to fulfill obligations to the society, as required by applicable laws.
  • Conviction of a criminal offense involving dishonesty or fraud, or imprisonment for a period of three months or more.
  • Acting in a manner prejudicial or detrimental to the interests of the society.

Mobile Banking Terms

Definition of Terms

QONAPAY refers to the mobile banking solution service.

PIN means any confidential password, code, or number—normally four digits—that may be used to access the QONAPAY services.

Transaction Fees refer to the charges applied to QONAPAY transaction services.

24-Hour Service Hotline refers to the telephone number provided for QONAPAY customers for queries related to QONAPAY services.

Subscriber means a customer who subscribes to use the QONAPAY service.

General Conditions

Joint Accounts, Corporate, and School Fees

Accounts held jointly by two or more persons with a mandate of “any sign” and those requiring more than one signatory will not be issued with QONAPAY service.

Use of Personal Identification Number (PIN)

  • A QONAPAY subscriber will receive an SMS confirming their registration and PIN.
  • The subscriber must change their PIN before using QONAPAY services.
  • The subscriber must exercise due care to ensure the secrecy of their PIN at all times and prevent unauthorized use by third parties.
  • If a problem arises, the SACCO may cancel or stop the service without notice, assigning any reason, or incurring liability to the subscriber until a solution is found.

Lost/Stolen SIM Card Registered for QONAPAY

  • If a subscriber loses their SIM card registered with QONAPAY, they must notify the SACCO immediately to block the QONAPAY service until the SIM card is replaced.
  • The subscriber remains liable for any transaction instructions affecting their SACCO account that are given using a valid PIN.
  • If a loss or theft report is communicated by someone other than the subscriber, the SACCO shall not be held liable for any resulting damages.

24-Hour Service Hotline

The 24-hour service hotline is included in the SMS received upon registration for QONAPAY. Subscribers should save the customer care number in their mobile device or frequently used telephone book for easy access.

Forgotten PIN

If a subscriber forgets their PIN, they must contact the SACCO to request a new one.

Cancellation or Stoppage of QONAPAY Service

  • A subscriber may cancel or unsubscribe from QONAPAY service at any time.
  • Payments made through QONAPAY service are irrevocable.

Charges

The SACCO will levy charges for using this service. Subscribers will be notified in advance of any changes to applicable fees.

Liability to the Subscriber

Subscribers are fully liable for each transaction instruction, subject to the terms and conditions of use.

Acts That Do Not Bind Either Party

Neither party shall be liable for any failure or delay in fulfilling obligations under this agreement if the cause is beyond their reasonable control. This includes, but is not limited to:

  • Network delays
  • Disruptions due to war, rebellion, or civilian unrest
  • Strikes and lockouts
  • Orders from government entities or regulatory bodies

If such circumstances arise, the affected party must notify the other as soon as possible. During the suspension of obligations, the other party may also suspend its obligations accordingly.

Amendment

The SACCO may amend these terms and conditions at any time by issuing a notice to subscribers. Subscribers will be informed of any changes through notices available at SACCO branches. Once published, amendments will be considered effective and binding.

Governing Law

These terms and conditions shall be governed and construed under the laws of the Republic of Kenya.


Email Indemnity

I hereby authorize QONA SACCO to act on email instructions (if opted for) without requiring additional written confirmation, unless instructed otherwise.

In consideration of the SACCO acting in accordance with the terms of this indemnity, I undertake to indemnify the SACCO and keep it indemnified against all losses, claims, actions, proceedings, demands, damages, costs, and expenses incurred or sustained by the SACCO. This applies to all matters arising out of or in connection with such notices, demands, or other communications, provided that the SACCO acts in good faith, except in cases where such losses, claims, or damages result from the SACCO’s willful negligence.

Email instructions will only originate from the pre-specified email address provided. These instructions shall be complied with until otherwise advised in writing.

I confirm that I have read, understood, and complied with all membership requirements as per the bylaws and general terms and conditions. Additionally, I confirm that the particulars I have provided are correct and true to the best of my knowledge.
